    The purpose of this Site is to provide a simple, convenient and cost-effective service to Food Lovers giving them access to various local restaurants allowing them to order online for takeaway or collection.

    By signing with us, our members can order food, and will have access to various other offers discounts, reviewing restaurants and so on.

  • Disclaimers and Limitation of Liability

    To the extent permitted by law, eat2save.co.uk provides this Site and content on an "as-is" and "as available" basis and we make no representation or warranty of any kind, express or implied, regarding the content or availability of this Site, or that it will be timely or error-free, that defects will be corrected, or that the Site or server that makes it available are free of viruses or other harmful components.

    Subject to the previous paragraph, neither eat2save.co.uk nor eat2save directors, officers, agents, employees or contractors shall have any liability for any direct, indirect, special or consequential losses or damages (including without limitation, damages for loss of business or loss of profits), arising in contract, tort or otherwise from the use or inability to use this Site.

    Nothing in these terms shall exclude or limits liability for death or personal injury resulting from our negligence or that of our agents or employees.

    You must indemnify and hold harmless eat2save.co.uk, its directors, officers, employees, agents, vendors, advertisers, partners and suppliers and keep them indemnified against all loss, actions, proceedings, costs, expenses (including legal fees), claims and damages arising from your Access to and use of this Site, any breach or violation of the Terms of Use of this Site or your violation of any law or your violation of the rights of any third party.

  • Availability

    This Site may be unavailable at certain times to allow for maintenance and upgrades. Although we will endeavour to notify customers in advance of any service unavailability, this cannot be guaranteed and we reserve the right to alter or withdraw the service at any time.

  • Limitations of Use

    This Site is intended to be accessed by persons located in the UK and we make no representation that any information, materials or functions included in this Site are appropriate for use in any other jurisdiction.

    By using this Site, you warrant that any personal information provided by you is true, accurate, current and complete in all respects and that you will notify us immediately of any changes to your personal information by updating your member profile on the Site or contacting us.

    You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use. You must be over 18 years of age to use our services. You are not allowed to register multiple memberships for use by the same person. Your membership may be terminated if this clause is violated.

    Members' passwords should be kept confidential at all times, and must not be shared or disclosed to anyone. You are responsible for all activities and orders that occur or are submitted through your membership. If you know or suspect that someone has knowledge of your password then you should change your password and please contact us immediately.

    You may not use the Site for any unlawful or unauthorised purpose, including without limitation: distributing any unlawful, libellous, abusive, threatening, harmful, obscene or otherwise objectionable material, transmitting material that constitutes a criminal offence, results in civil liability or otherwise breaches any laws, regulations or codes of practice.

    Interfering with any other persons use or enjoyment of the Site. Damaging, disabling or impairing the operation of this Site or attempting to gain unauthorised access to this Site or to networks connected to it, through hacking, spoofing or other such similar means.

  • Food Ordering

    Eat2save.co.uk deal with reputable third parties who provide a quality Food &Service, however eat2save.co.uk accepts no responsibility or liability for the quality or quantity of any goods delivered by or collected from said third parties. It is the responsibility of the customer to thoroughly check the supplied goods before agreeing to pay for an order. Any and all questions regarding goods shown on this Site should be directed to the partner restaurant.

    When you place an order, we provide you an order number; please remember this is an acknowledgement of your order, not acceptance.

    When an order is accepted you will see your order either accepted in your member area or email confirming that the restaurant has received and accepted your order. If the restaurant is unable to fulfil your order you will be able to see order is pending or rejected in your member area and you will receive an email stating that your order has been declined if the order has been rejected by a restaurant.

    Please do make sure the email address you provide is correct and your mailbox is in proper working order, as all correspondence regarding your order is sent to this address. Your contact number is very important as you might be contacted by restaurant if necessary.

    All food preparation and deliveries are the sole responsibility of the restaurant accepting the order. Please be aware that the restaurant will do everything they can to meet the delivery time you specified, however delivery times may be affected by factors beyond their control and therefore cannot be guaranteed. Restaurant will inform you if they are facing any unexpected delay.

    Members can also track the progress of their orders by viewing their Order History under their member area.

  • Alcohol and Cigarettes

    Pursuant to the Licensing Act 1964, it is an offence for any person under the age of 18 to buy, or attempt to buy, intoxicating liquor, or for any person over the age of 18 to buy intoxicating liquor on behalf of any person under the age of 18. Cigarettes are not for sale to minors under the age of 16. Orders containing either alcohol or cigarettes can therefore not be accepted from minors.

  • Payment

    Once your order has been accepted, this represents an agreement between you the customer and the restaurant. The restaurant has sole responsibility for this order. Cash payments are made directly to the restaurant when the order is completed. If you have chosen to pay with credit or debit card on the Site then the transaction is processed by eat2save.co.uk as an authorised agent of the restaurant.

    All prices are inclusive of VAT and quoted in British (Sterling) Pounds. Delivery and/or card charges are calculated per order and based on the policy of the individual restaurant. Prices are subject to change and all goods are subject to availability.

  • Cancellation

    While every effort is made to ensure that accurate pricing and descriptions are maintained, we reserve the right to cancel any order that is based on inaccurate information.

    You cannot cancel a takeaway order after payment is made. Takeaway orders for payment directly to takeaway or restaurant cannot be cancelled once it is confirmed by you and Proceed to Pay button is clicked.

    You may however call the restaurant and request for the order to be declined. Takeaway orders accepted by a takeaway or restaurant cannot be cancelled.

    An order may be subsequently cancelled by a restaurant after you have received an email stating the order has been accepted. Eat2save.co.uk and our partner restaurants reserve the right to cancel any order, before or after acceptance, and will notify you immediately of any such cancellation.

  • Customer Ratings

    The ratings contained on this Site are for informational purposes only and do not constitute advice. Nor should you rely on ratings to make (or refrain from making) or take (or refrain from taking) any action. Ratings are the opinions of customers who have ordered through the Site, and any statements, advice or opinions made by such customers are those of such customers only.

  • Special Offers and Promotions

    Third Party Promotions Takeaways and restaurants will be able to offer promotions and discounts through the System on orders from you to them ("Third Party Promotions"). You will have the opportunity to select any one applicable Third Party Promotion to be applied to the order when making a payment.

    An applied Third Party Discount is earned when an order is placed with a participating third party on the System and the order is accepted and fulfilled by the given takeaway or restaurant. Third Party Promotions are offered in the sole discretion of the participating takeaway or restaurant and eat2save will not be liable for any Third Party Promotion offers.

    You may earn a maximum of one Third Party Discount per order. Offers and discounts provided in Third Party Promotions may change without notice, and the offer may be withdrawn either from individual participating restaurant or takeaway or from the whole of the System without prior notice and with immediate effect. In such circumstances, any discounts due will be void, and neither the restaurants nor eat2save may be held liable for any losses incurred as a result.

    Third Party Discounts offer is non-exchangeable, and may only be used as described in these Terms.

  • Enforceability

    If any part of these Terms is deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any of the remaining provisions of these Terms. No waiver by us shall be construed as a waiver of any preceding or succeeding breach of any provision.

  • Governing Law

    These System Terms shall be governed by and construed in accordance with English law. Disputes arising in connection with these System Terms (including non-contractual disputes) shall be subject to the exclusive jurisdiction of the English courts.

  • Additional terms

    We are committed to protecting your privacy and security. All personal data that we collect from you will be processed in accordance with eat2save Privacy Policy. You should review our Privacy Policy, which is incorporated into these System terms by this reference. Any failure or delay by you or us in enforcing (in whole or in part) any provision of these System Terms will not be interpreted as a waiver of your or our rights or remedies.

    You may not transfer any of your rights or obligations under these System Terms without our prior written consent. We may transfer any of our rights or obligations under these System Terms without your prior written consent to any business that we enter into a joint venture with, purchase or are sold to. The headings in these System Terms are included for convenience only and shall not affect their interpretation.

  • Written communications

    Applicable laws require that some of the information or communications we send to you should be in writing. When using the System or ordering products via the System, you accept that communication with us will be mainly electronic. We will contact you by email or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

  • Events outside our control

    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a contract that is caused by events outside our reasonable control ("Force Majeure Event").

    A Force Majeure Event includes any act, event, non-happening, omission or accident beyond our reasonable control and includes in particular (without limitation) the following:

    a) strikes, lock-outs or other industrial action; b) civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war; c) fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster; d) impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport; e) impossibility of the use of public or private telecommunications networks; and f) The acts, decrees, legislation, regulations or restrictions of any government.

    Our performance under any contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the contract may be performed despite the Force Majeure Event.

  • Entire agreement

    These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any contract.

    The security of your personal information is important to us. Our System is generally intended to be used by consumers to search for restaurants and takeaways and order food online.

    When you sign-up with usyou will be asked to provide information about yourself including your name, contact details and other information. Our website is linked to a secure payment Gateway PayPal and your credit/ debit card details are collected by the payment gateway only. We do not collect and store your credit card details.

    In some instances, our website and mobile application may include various location-based features, such as determining your geo location. To provide these location-based features, eat2save and the restaurants may collect, use and share your location data, including the real-time geographic location of your mobile device.

  • Use of your Information

    We may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the System or our services.

    Where you have indicated accordingly, you agree that we may use your information to let you know about our other products and services and those of our member restaurants as displayed on eat2savesite that may be of interest to you including services that may be the subject of direct marketing and we may contact you to do so by post, telephone, mobile messaging as well as by e-mail.

    You agree that we may also share information with third to use your information in order to let you know about goods and services which may be of interest to you (by post, telephone, mobile messaging e-mail) and to help us analyse the information we collect so that we can administer, support, improve and develop our services to you.

    During signup we ask you supply a password which is required to login and placing an order, also this gives you access to your personal details. It is very important and you are responsible for keeping this password confidential. We advise you not to share your password with anyone.

    Unfortunately, the transmission of information via the internet is not completely secure. Although we will take steps to protect your information, we cannot guarantee the security of your data transmitted to the System; any transmission is at your own risk.
